Empathy In Sentencing

Falconers LLP lawyer Anthony Morgan was interviewed on Metro Morning, CBC Radio on June 13, 2016. Morgan shared his thoughts on why he believed Ontario Superior Court of Justice Edward Morgan came determined that a conditional sentence was appropriate when one has account of the anti-black discrimination facing African Canadians in society generally, and including their interaction with the justice system.

Morgan stated “While this court is not in a position to remedy the societal issues, it can and should take the societal context into account in fashioning an appropriate sentence for an individual offender”. To listen to the interview click here.
