December 6, 2018- CBC’s Judicial Review Application on Secret DeBungee Police Service Act Hearing, Heard by the Court in Thunder Bay

Falconers LLP lawyers, Julian Falconer and Krystyn Ordyniec were before the three Justices of the Divisional Court who heard the Judicial Review of Mr.Ferrier’s decision to make the extension motion secret.

The issue was whether or not Mr. Ferrier’s decision to hold the proceedings in-camera and excluding the public should be set aside.

Falconers LLP, lawyers for the First Nations Public Complainants, Rainy River First Nations and Brad DeBungee, argued that Mr. Ferrier’s failure to apply the openness and transparency principles articulated in the Charter and common law warranted a finding by the court that the decision should be overturned and the process should be open to the public.
