MCGILL’S FIRING OF INDEPENDENT EXPERT PANEL LANDS PARTIES BACK IN COURT

Kimberly Murray, the Independent Special Interlocutor for Missing Children and Unmarked Graves and Burial Sites associated with Indian Residential Schools (“the Independent Special Interlocutor”) intervened in court proceedings in Montreal, Quebec on October 27, 2023, to support the Mohawk Mothers who are challenging the Defendants, McGill, the Royal Victoria Hospital, and Quebec government agencies (the Société Québécoise des Infrastructures) for their breach of a landmark settlement agreement.

The proceedings come only six months after the agreement was arrived at and in the wake of the controversial firing of an independent panel of archeologists that lies at the heart of the agreement. Argument proceeded for the entirety of the day before Justice Gregory Moore of the Quebec Superior Court.

The Independent Special Interlocutor, represented by Julian Falconer and Mitchell Goldenberg of Falconers LLP, sought, and was granted intervenor status in the proceedings dating back to October 27, 2022.
