“There are none so blind as those who will not see” – SIU Releases Corrigendum and Clears Police of Any Wrongdoing, Again

On June 8, 2026, the Special Investigations Unit (“SIU”) released a Corrigendum (correction) to its Director’s Report, initially released on July 14, 2025. Prior to its public release, legal counsel for the Ostberg-Beardy family sent correspondence to the SIU on May 22, 2026, outlining outstanding concerns with the SIU’s investigative process and remaining issues related to the investigation into the death of Jenna Sapporah Ostberg on December 30, 2023. The SIU determined that errors in its investigation were the result of inadvertence and an incomplete review by examiners.

Despite the Corrigendum identifying irreconcilable issues related to the Thunder Bay Police Service’s actions and the Subject Officer’s (“SO”) decisions, the SIU maintained its conclusion “that there are no reasonable grounds to believe that the SO’s actions constituted criminal negligence causing death.”

Less than three (3) months ago, Grand Chief Fiddler of Nishnawbe Aski Nation sent correspondence to the SIU regarding its repeated failures to understand Indigenous Peoples. These gaps in services continue to exacerbate the disproportionate violence and racism that Indigenous people in Northern Ontario continue to face.
