Upcoming Ontario Court of Appeal Hearing: B.M. v. Ontario (September 28–29)

As the upcoming hearing at the Ontario Court of Appeal approaches, we want to remind our community and supporters to mark their calendars for September 28 and 29, 2026. These two days will be critical as the Court hears the appeal of the decision B.M. v. Ontario, a vital legal battle challenging the lower court’s denial of class-action certification. Nishnawbe Aski Nation (NAN) is looking to hold the province accountable for systemic failures and seeks long-awaited justice and compensation for off-reserve Indigenous children and families. Falconers LLP has the privilege of representing NAN in these proceedings as it continues to advocate for meaningful structural reform.
Hearing participants and observers are reminded that, unless permission is given by the Court, it is an offence under s. 136 of the Courts of Justice Act, R.S.O. 1990, c. C.43, punishable by a fine of not more than $25,000 or imprisonment of up to six months, or both, to record any part of a hearing, including by way of screenshot/capture and photograph, as well as to publish, broadcast, reproduce or disseminate any such recording.
