First Nations Public Complainants Appeal the Decision of the Divisional Court

On Tuesday, January 22, 2019, the First Nations Public Complainants (Rainy River First Nations and the family of the late Stacy DeBungee) filed notice for leave to appeal the January 7, 2019 decision of a panel comprised of Justices Warkentin R.S.J, Aitken and Mulligan JJ, wherein the Divisional Court ruled that the decision of Mr. Lee Ferrier to hold the extension motion in camera should be upheld.

The First Nations Public Complainants appeal raises issues of significance to the parties and to the public as a whole and addresses whether the hearing should be held in camera, and further whether that decision maker should be afforded the same level of deference as the administrative body despite not having the same level of knowledge and expertise.
