
Marshalling Race Based Evidence in the Post R v Brown Era – Queens Law Guest Presentation

On Monday October 20, 2025, Falconers LLP partner Julian Falconer and associate Shelby Percival attended at Queens Law in Kingston, Ontario for a guest presentation on racism and policing to a group of upper year students. Students attended from two different classes, including a human rights course taught by Professor Kimberly Murray, as well as a second-year evidence course taught by Professor Lisa Kerr.
The presentation began with an overview and background of Falconers LLP, including the opening of an office in the North to reflect the firm’s work involving Indigenous-based issues (comprised of both individual matters and organizational support).
The presentation also examined the historic case of R v Brown, and how the marshalling of racial profiling and race-based evidence has changed since 2003. Julian and Shelby shared information about the firm’s work with Dafonte Miller, the Seven Youth Inquest, the death of Stacy DeBungee and the resulting Broken Trust report from the Office of the Independent Police Review Director (“OIPRD”) that found that “systemic racism exists in the Thunder Bay Police Service at an institutional level” (pg. 184).
Julian and Shelby were honoured to present to a group of talented young legal professionals, who asked insightful questions stemming from the presentation and how it relates to the material they were learning in their human rights and evidence courses.
