
TPS Constable Receives Suspended Sentence and Weapons Prohibition for Off-Duty Assault on Brampton Teen

On Wednesday June 18, 2025, Justice Jennifer Woollcombe sentenced Toronto Police Service (“TPS”) Constable Calvin Au (“Constable Au”) to a suspended sentence, as well as imposing a weapons prohibition for three years, at the Brampton Superior Court of Justice. Justice Woollcombe did not make an exception for employment in the weapons prohibition, meaning that Constable Au is not able to possess a firearm (amongst other weapons listed in the Criminal Code) for the next three years.
In addition to the suspended sentence and weapons prohibition, Constable Au was sentenced to 12 months probation, 50 hours of community service, anger management sessions, and will be required to provide his DNA to the court.
On November 27, 2024, Constable Au was found guilty of assault committed against Chadd Max Facey on April 26, 2021.
On April 26, 2021, Chadd had met up with Constable Au and his partner Constable Gurmakh Benning (“Constable Benning”), both of whom were off duty, to sell an Apple watch that he has posted on Kijiji. Following the meet up, there was a physical altercation between Constable Au and Chadd, resulting in Chadd sustaining a head injury. In the evening of April 26, 2021, Chadd was taken to Brampton Civic Hospital by ambulance, where he later passed away.
